Terms of service
1. Scope
1.1. REYGERS, represented by Hubertus Reygers, located at Widenmayerstrasse 49, 80538 Munich, operates as a retail business offering customers pre-owned watches, jewelry, antiques, and art for purchase.
1.2. The following General Terms and Conditions (GTC), in their version valid at the time of the order, exclusively govern the business relationship between REYGERS and the purchaser. Any terms deviating in whole or in part from these GTC are not recognized by REYGERS unless explicitly agreed to in writing.
2. Offers, Acceptance, Conclusion of Contract
2.1. All offers made by REYGERS are non-binding and considered invitations to submit an offer.
2.2. A customer’s order represents an offer to REYGERS to conclude a purchase agreement.
2.3. If REYGERS determines during order processing that the requested item is no longer available, the customer will be informed via email. As REYGERS operates a retail store in Munich, in-person purchase inquiries are prioritized.
2.4. Acceptance of the customer’s order is confirmed by REYGERS either verbally with subsequent written confirmation or via email. This email contains details of the order and payment (Order Confirmation) and constitutes acceptance of the customer’s offer, thereby forming the purchase agreement. The content of the contract is determined by the Order Confirmation and these GTC.
3. Prices, Payment Terms, Due Dates
3.1. REYGERS will indicate whether the sale of the used items is subject to differential taxation according to § 25a UStG or regular VAT. This will be specified on the invoice.
3.2. Payments are accepted exclusively via advance payment.
3.3. Shipment occurs only after full payment of the purchase price and shipping costs by the customer.
3.4. The total purchase price, including shipping costs (see Section 5.3), will be invoiced in the Order Confirmation. The total amount becomes due upon receipt of this confirmation.
3.5. Customers are required to pay the total amount immediately upon receipt of the Order Confirmation.
3.6. Alternatively, customers may pay 30% of the total amount within seven days of receiving the Order Confirmation. The remaining 70% must be paid within one month. Late or incomplete payments may result in default as outlined in Sections 3.6 and 3.7.
4. REYGERS’ Right to Withdrawal
4.1. If the customer fails to fulfill payment obligations within the specified timeframe, REYGERS reserves the right to withdraw from the contract without prior notice. Partial payments made will be refunded within 30 days.
4.2. Withdrawal will be communicated in writing via email.
5. Delivery, Shipping Costs, Risk Transfer
5.1. Orders are shipped promptly after payment receipt to the delivery address provided by the customer. Due to insurance requirements, deliveries are limited to business or office addresses.
5.2. Shipments are dispatched on business days, Monday through Friday.
5.3. Shipping costs are borne by the customer and will be provided upon request.
5.4. Customers may also collect items directly from the REYGERS store by arrangement.
5.5. Shipping is always insured, carefully packaged, and typically managed by Parcel Broker or a similar logistics provider.
5.6. For consumers (§ 13 BGB), the risk transfers upon receipt of the goods. For entrepreneurs (§ 14 BGB), the risk transfers upon handover to the shipping company.
6. Transport Damages
Transport damages must be reported immediately to the carrier. Complaints regarding defects must be described precisely and submitted in writing to REYGERS within three days of receipt.
7. Right of Withdrawal and Return Costs
Customers who qualify as consumers have a right of withdrawal.
Withdrawal Policy
You may withdraw from the contract within 14 days without providing reasons. Written notice (letter, fax, or email) or the return of goods is sufficient.
Consequences of Withdrawal
Upon valid withdrawal, mutual obligations are reversed. Customers may be liable for diminished value due to use beyond inspecting properties and functionality.
8. Warranty, Liability, and Damages
8.1. Liability for defects in pre-owned items is excluded for entrepreneurs.
8.2. For consumers, claims for damages due to defects are excluded, except in cases of gross negligence or breach of significant contractual obligations.
8.3. Routine wear and tear (e.g., scratches or loss of time accuracy) are excluded from the warranty unless otherwise stated.
9. Procurement Risk
REYGERS assumes no procurement risk and reserves the right to withdraw from the contract if items cannot be supplied without fault on its part.
10. Offset and Retention
10.1. Customers may only offset claims if undisputed or legally binding.
10.2. Retention rights apply only to claims arising from the same contractual relationship.
11. Data Protection
REYGERS adheres to data protection regulations, collecting only necessary personal data for contract fulfillment. Data will not be shared without explicit consent, except where necessary for contractual purposes.
12. Governing Law and Jurisdiction
12.1. German law exclusively applies, excluding the UN Sales Convention.
12.2. For merchants, legal entities, or public institutions, Munich is the exclusive jurisdiction for disputes arising directly or indirectly from this contract.
